In U.S. v. American Library Association (2003), the Supreme Court upheld the Child Internet Protection Act (CIPA), which mandated that libraries receiving federal funding for public Internet access install content-filtering programs on computers which provide that access. These programs analyze incoming content, and block the receipt of objectionable material, in particular pornography. Thus, patrons at public libraries are protected from unintentionally (or intentionally) accessing objectionable material, and, in the case of minors, from accessing potentially damaging material. At (...) least, that is the official story. In this paper, I develop three points. (1) I argue that CIPA and ALA are better read as examples of the enforcement of a regime of normative sexuality. The question of minors accessing pornography is only relevant to the official story insofar as it provides a rhetorically persuasive example of deviance from that normative regime. CIPAs full target includes information about topics such as homosexuality and contraception. (2) Rather than (or in addition to) punishing deviances directly, CIPA attempts to constitute a “public” in which such deviancy can never occur in the first place. Hence, the designation of a “public” space serves to domesticate alternative sexualities and to sanitize that space of sexual difference. (3) This interaction at the border of the public and private spheres offers an opportunity to reflect on and underscore the ways that subject formation and subjectivity are mediated through technological artifacts like the Internet. The COVID-19 pandemic has forced libraries to shift their service-delivery model online, infiltrating countless interactions–from storytime to reference questions to social groups–into digital mediation, typically by third-party platforms outside the library’s control, generating mineable, persistent digital traces. One community particularly vulnerable to the impacts of surveillance is the queer community, where an outing, at least in the United States, imposes a potential loss of housing and employment and may subject the outed person to violence. Libraries–particularly public and school libraries–have (...) once again become sites of conflict and resistance, with queer people and materials increasingly coming under attack both physically and legally. A primary shield by which libraries try to protect their patrons from such attacks is “privacy.” Librarians, as professionals, proclaim a commitment to privacy embedded in such documents as the American Library Association’s Library Bill of Rights and the International Federation of Library Associations and Institution’s Statement on Privacy in the Library Environment. However, these ideals exist in broader systems–including legal and cultural structures–which constrain and complicate abstract commitments to privacy. This article examines the challenges of queer digital privacy within libraries in the United States, focusing on the polysemous, boundary-crossing nature of queerness, the digital and the material, privacy, and libraries (as both concepts and institutions). In particular, this article demonstrates how binary-bound, individual-rights-oriented legal approaches to privacy have arisen, and been mediated, by cis-heteronormative patriarchal values and how the sociotechnical materialities in which they occurred (such as paper-based recordkeeping) are fundamentally incompatible with queer privacy needs. This article is about the relationship between reading, trauma and responsive literary caregiving in Britain during the First World War. Its analysis of two little-known documents describing the history of the War Library, begun by Helen Mary Gaskell in 1914, exposes a gap in the scholarship of war-time reading; generates a new narrative of "how," "when," and "why" books went to war; and foregrounds gender in its analysis of the historiography. The Library of Congress's T. W. Koch discovered (...) Gaskell's ground-breaking work in 1917 and reported its successes to the American Library Association. The British Times also covered Gaskell's library, yet researchers working on reading during the war have routinely neglected her distinct model and method, skewing the research base on war-time reading and its association with trauma and caregiving. In the article's second half, a literary case study of a popular war novel demonstrates the extent of the "bitter cry for books." The success of Gaskell's intervention is examined alongside H. G. Wells's representation of textual healing. Reading is shown to offer sick, traumatized and recovering combatants emotional and psychological caregiving in ways that she could not always have predicted and that are not visible in the literary/historical record. The Telecommunications Act of 1996 is considered landmark legislation, especially in the area of universal service. However, the FCC performed even more groundbreaking activity. The FCC was given wide latitude by the Act to interpret the universal service provisions of the Act either narrowly or broadly; the FCC chose the latter. The FCC's interpretation of the Act will have a significant impact on the level of technology implementation and use in American classrooms and libraries. In March 1996, the FCC (...) issued a Notice of Proposed Rulemaking on Universal Service. The NPRM also established a Federal-State Joint Board composed of three FCC Commissioners, four state public service commission representatives nominated by the National Association of Regulatory Utility Commissioners, and one utility consumer advocate nominated by the National Association of State Utility Consumer Advocates. On November 8, 1996, the Joint Board released its Recommended Decision and the FCC adopted its rules based on that recommendation in May 1997. The FCC ruled that all eligible schools and libraties should receive discounts of between 20 and 90 percent on all telecommunications services, Internet access, and internal connections, subject to a $2.25 billion annual cap. In addition, any funds not disbursed in a given year may be carried forward and disbursed in subsequent years without regard to the cap. This provision, according to the FCC, will provide schools and libraries with the maximum flexibility to purchase the services that will meet their communications needs most effectively. In a separate section of the rules, the FCC defined "core services" as: • Voice-grade access to the public switched network, with the ability to place and receive calls • Dual Tone Multifrequency signaling or its functional equivalent • Single-party service • Access to emergency services • Access to operator services • Access to interexchange services • Access to directory assistance. • Support for toll limitation services for low-income consumers. However, as stated in the Act, the FCC was given the latitude to include additional services for schools and libraries. It could have chosen to provide schools and libraries with discounts on only core telecommunications services; core services plus some complement of additional services; or all telecommunications services. The FCC adopted the third option, that discounts be provided on all telecommunications services. It stated that this guideline would provide schools and libraries the maximum flexibility to purchase whatever package of telecommunications services they believe would meet their telecommunications service needs most effectively and efficiently. _Current Status:_ The FCC ruled that it will permit schools to begin using discounted services on January 1, 1998. Each profession has its own code of ethics. The Merriam-Webster Online Dictionary (2008) defines professional ethics as "the principles of conduct governing an individual or a group." The Code of Ethics of the American Library Association (ALA Council 2008) has served librarians for seventy years and reflects the ideals toward which aII librarians strive. While they are not step by step directives, the statements in the Code provide a moral framework for school library media specialists in (...) their daily practice. In lieu of an abstract, here is a brief excerpt of the content:"Periwigged Heralds":Epistemology and Intertextuality in Early American CometographyChristopher JohnsonIn the winter of 1680-81 an enormous comet appeared in the nighttime skies of Europe and the Americas.1 This "blazing star" occasioned numerous treatises, poems, pamphlets, broadsides, ballads, engravings, and woodcuts. Evaluating this cometary copia, the historian of science, Pingré, in 1783 observes:The world was inundated with writings on these phenomena, on their nature, on their significations; for there were (...) still astrologers and cometomantics [Cométomantiens]... I believe that the languages were not even as confused at the Tower of Babel, as were the sentiments concerning this famous comet.2Pingré's belated impatience with the discursive flood of "astrologers and cometomantics" echoes of course the more general Cartesian objection to the confusion of words and things, a confusion that L'Académie des sciences and Royal Society dedicated themselves to eliminating. But the arduous nature of this effort in seventeenth-century Europe is exemplified by the numerous, often-conflicting interpretations of the 1618, 1665, and 1680 comets—to say nothing of the unprecedented "new stars" or novas of 1572 and 1604, which were often treated as cometary phenomena. In this essay, though, I will trace the contours of this epistemological confusion in the Americas—specifically in [End Page 399] Mexico, Peru, and New England—where European astronomical, astrological, theological, and literary discourses concerning comets were repeated and imitated but also where they were mediated by cultural concerns unique to the New World. More particularly, by focusing on some of the intertextual aspects of the interpretation of the 1680 comet in the Americas, I suggest that the hermeneutic of signs which dominated in one way or another almost every Early American cometography is indicative of broader epistemological and rhetorical tensions that characterize the period.Popular belief in late seventeenth-century Europe generally held that a comet's appearance heralded God's wrath. In Germany the terrible "Wunder-Komet" of 1680 precipitated the publication of nearly a hundred treatises, most of which echoed the motto on a medal struck by the State Library of Zurich: "The star threatens evil things. Have faith! God will set things right."3 The devout comet-watcher could thus look forward to imminent salvation, while sinners were urged to seize a final chance to repent. Still, even many of the learned who treated comets mathematically also embraced some form of theological hermeneutic. Both Kepler and, later in his life, Newton wished to retain comets as actors in God's eschatological drama.4 Though others, like Galileo and Gassendi, saw the comet as a natural event without semiotic significance, the more astrologically inclined continued to see it not just as a sign but as the effective cause itself of ill, or less often, good fortune.5 Stanislaw Lubieniecki's1667 Theatrum cometicum thus places one comet at Jerusalem's destruction and another at Christ's birth.6 In other words, the Theatrum, like most contemporary cometographies, is fueled by the logic of analogy, for a comet was generally read as a wondrous (but usually disastrous) sign linking the microcosm and macrocosm, or alternately, as a sign legible only by translating the Book of Nature with the lexicon provided by the Book of God, the Bible.7 When it came to comets, the epistemic shift that Foucault traces in The Order of Things, from a sixteenth-century symbolic or qualitative world-view to a seventeenth-century rationalist or quantitative one, was often slowly and/or incompletely achieved. Forced to speak of a comet's "beard" or "tail," even the less mantic cometographers found themselves interrogating the analogical nature of their discourse as much as the celestial objects that excited their curiosity. Modern American nursing has an extensive ethical heritage literature that extends from the 1870s to 1965 when the American Nurses Association issued a policy paper that called for moving nursing education out of hospital diploma programs and into colleges and universities. One consequence of this move was the dispersion of nursing libraries and the loss of nursing ethics textbooks, as they were largely not brought over into the college libraries. In addition to approximately 100 nursing ethics textbooks, (...) the nursing ethics heritage literature also includes hundreds of journal articles that are often made less accessible in modern databases that concentrate on the past 20 or 30 years. A second consequence of nursing’s movement into colleges and universities is that ethics was no longer taught by nursing faculty, but becomes separated and placed as a discrete ethics (later bioethics) course in departments of philosophy or theology. These courses were medically identified and rarely incorporated authentic nursing content. This shift in nursing education occurs contemporaneously with the rise of the field of bioethics. Bioethics is rapidly embraced by nursing, and as it develops within nursing, it fails to incorporate the rich ethical heritage, history, and literature of nursing prior to the development of the field of bioethics. This creates a radical disjunction in nursing’s ethics; a failure to more adequately explore the moral identity of nursing; the development of an ethics with a lack of fit with nursing’s ethical history, literature, and theory; a neglect of nursing’s ideal of service; a diminution of the scope and richness of nursing ethics as social ethics; and a loss of nursing ethical heritage of social justice activism and education. Despite the rapid proliferation of (...) critical texts addressing themselves to black writing, it remains the case that many critics come to black writing with methodologies and agendas already in hand, while few critics have taken upon themselves the task of rereading the critical history of African-American work in theory. This has often resulted in a sort of critical shortsightedness, with the field of black literary theory presented as a foreshortened, if now more level, playing field. While some have engaged in arguments about the question of whether or not African-American writing should be engaged by poststructuralist theorists (a question that seems to begin with the assumption that poststructuralism is a particularly white mode of mythology), the fact is that a form of deconstruction had been theorized by an African-American poet long before deconstruction had entered the American academy. That this fact is largely unknown among contemporary critics is the result of a continuing practice of not reading the theoretical work of black poets who have published outside the established circuit of the academic press. With the prominent exceptions of poets like Amiri Baraka, June Jordan, Larry Neal, and Haki Madhabuti, the critical writings of recent African-American poets have seldom been collected and circulated in any very effective way. Characteristically, Neal’s essays were gathered into a book posthumously, and Madhabuti’s have been published and distributed primarily through his own publishing house. Even Baraka’s collections have been allowed to pass out of print in most instances, only the books on music remaining readily available throughout his career. This may change for black poets who write in more mainstream modes in the near future. Now that Rita Dove has served a term as Poet Laureate of the United States and Derek Walcott has won the Nobel Prize, we might expect a modest increase in interest by publishers and readers in critical works by poets whose forms are less troubling than their content. And black poets who attain academic credentials and write scholarly/critical essays, such as Nathaniel Mackey and Harryette Mullen, may succeed in getting their works published by the university presses. However, surveys of shelves in bookstores and [End Page 86] libraries will confirm that there has been little concern among even university and small presses to collect and preserve the critical legacy of black experimentalists in the way that the essays of Charles Olson, Ed Dorn, or Robert Creeley have been maintained before a public.Russell Atkins has been one of the most prolific and demanding of black poets writing criticism and theory in the last four decades, but like Percy Johnston, central figure of the Dasein group of poets centered at Howard University in the 1950s, he has had to publish most of this work through his own magazine and workshop press, and there has never been a published collection of his critical work. The special Russell Atkins number of the Free Lance, a journal with which Atkins was associated for two decades, included a section surveying his work in critical prose, but little of that work has found its way into the broader critical discourse of literary scholars (it has fared a little better with musicologists), and Atkins’s prose is infrequently cited. Virtue ethics is now well established as a substantive, independent normative theory. It was not always so. The revival of virtue ethics was initially spurred by influential criticisms of other normative theories, especially those made by Elizabeth Anscombe, Philippa Foot, John McDowell, Alasdair MacIntyre, and Bernard Williams. 1 Because of this heritage, virtue ethics is often associated with anti-theory movements in ethics and more recently, moral particularism. There are, however, quite a few different approaches to ethics that can reasonably claim (...) to be versions of virtue ethics. The predominant strand of virtue ethics is broadly Aristotelian, although some accounts bear little resemblance to Aristotle's. In its most general form, virtue ethics is compatible with a wide range of meta-ethical and normative commitments. This diversity makes it difficult to compare virtue ethics as such with other normative theories. It can also be a challenge to see just what the various versions of virtue ethics have in common with each other. Three major types of virtue ethics are represented in the books by Rosalind Hursthouse, Michael Slote, and Christine Swanton, recommended in the following section. Each of these book sets forward a considerably self-standing form of virtue ethics. The authors differ on central issues such as the relationship between virtue and flourishing and the link between virtuous agents and right or virtuous actions. Unlike Swanton and Slote, Hursthouse defends a version of ethical naturalism that has affinities with theories recently defended by Philippa Foot and Alasdair MacIntyre. 2 Slote's theory is agent-based, meaning that his account derives judgments about the moral status of actions from moral features of agents. Hursthouse and Swanton defend theories according to which the moral status of an action depends on its broader relationship to human flourishing (Hursthouse) or whether it hits the target of a virtue (Swanton). Although these three books presently form the core of contemporary virtue ethics, there are other approaches that might reasonably be described as versions of virtue ethics, such as those presented by Julia Driver, Linda Zagzebski, and Robert Adams. 3 There are also, of course, a large number of articles in which authors defend or criticize tenets that are central to most versions of virtue ethics. Some recent articles on especially important topics are listed in the following section. Current 'hot topics' in virtue ethics include whether its account of right action is adequate and whether virtue ethics is at odds with empirical psychology. Articles on these debates and others are listed in the following section. For each book, I have also listed an article by the same author in which he or she articulates some similar themes. Jonathan Lear, member of the Committee on Social Thought at the University of Chicago, psychoanalyst, and author of works on Aristotle’s logic and epistemology and a philosophical interpretation of Freudian psychoanalysis, has compiled a collection of 12 essays, all but three previously published, reflective of his varied training and talents. The essays themselves range from a piece in The New Republic on the “Freud-bashing” that led to the cancellation of the Library of Congress’s exhibition “Sigmund Freud: Conflict and Culture” (...) late in 1995 to fairly technical pieces written for the Journal of the American Psychoanalytic Association, Phronesis, and the Proceedings of the Aristotelian Society. Original dates of publication range widely as well, from 1984 to 1996, and would seem to mark the author’s intellectual pilgrimage, outlined in his Preface: from the preserves of analytic philosophy, often identified by him with professional philosophy simpliciter, to the more “open-minded” concern with the history of philosophy and Freudian psychoanalysis. He contrasts his own concern with the Platonic problem, “giving a logos of the psyche” or “working out the logic of the soul,” to the computationism of modern psychology departments and to “ersatz philosophy.” Ersatz philosophy is exemplified, in his interpretation by Oedipus’ thoughtless, self-oblivious argumentation which, according to a footnote, may count its “modern descendants in verificationism, Popperianism, ordinary-language philosophy”. In a passage that explains the book’s title, Lear affirms the truth that he believes Socrates’ life represented: “that we have the capacity to be open minded: the capacity to live nondefensively with the question of how to live”. The Journal of Economic Literature codes classification system (JEL) published by the American Economic Association (AEA) is the de facto standard classification system for research literature in economics. The JEL classification system is used to classify articles, dissertations, books, book reviews, and working papers in EconLit, a database maintained by the AEA. Over time, it has evolved and extended to a system with over 850 subclasses. This paper reviews the history and development of the JEL classification system, describes (...) the current version, and provides a selective overview of its uses and applications in research. The JEL codes classification system has been adopted by several publishers, and their instructions are reviewed. There are interesting avenues for future research as the JEL classification system has been surprisingly little used in existing bibliometric and scientometric research as well as in library classification systems. It is far more inclusive in many respects than The Philosopher’s Index.The Database of Classical Bibliography (DCB) is a long-term project sponsored by the N.E.H., the American Philological Association and others to make the full contents of APh accessible from a CD-ROM either from individual PCs or on a local network. Unlike the Thesaurus Linguae Graecae, the DCB CD-ROM comes with its own search software (DCB CompLex) on the disk. This software is set up both for IBM and MAC machines, installs quickly, and operates extremely well. The manual gives clear instructions both for general use and for detailed search strategies. CompLex enables the user to search DCD in many different ways; e.g., by ancient or modern authors and works, by titles, publisher, place of publication, year of publication, journal, modern language, or series name, as well as by APh volumes, years, page numbers, rubrics, and topics. It can also search by any word in a modern language (i.e., in Roman characters) or for words in a Greek index. And CompLex enables one to perform more complex searches utilizing wildcards and Boolean operators in a user-friendly form.DCB Version 2, containing Volumes 45–60 (1974–1989), fulfills the editor’s initial commitment to make a new release available each year with the addition of three to five years, since it includes four years of APh (1973–74 and 1988–89) not on Version 1. Also new in Version 2 is a French interface and manual.DCB has faults, however. It repeats mistakes that appeared in the print version of APh and contains other mistakes that did not originate in APh. Many were noted in reviews of Version 1, but this should not be surprising in a work of such magnitude as either APh or DCB. What is perhaps disturbing is that errors noted in Version 1 have not been corrected in Version 2, though it would not seem difficult to make use of the information provided by careful reviewers.Nevertheless, DCB is a terrific scholarly tool. This discussion paper critically assesses the American Nurses Association’s stated arguments against nurse participation in assisted suicide, as found in its current (2013) position statement. Seven distinct arguments can be gleaned from the American Nurses Association’s statement, based on (1) the American Nurses Association’s Code of Ethics with Interpretive Statements and its injunction against nurses acting with the sole intent to end life, (2) the risks of abuse and misuse of assisted suicide, (3) nursing’s (...) social contract or covenant with society, (4) the contention that nurses must not harm their patients, (5) the sanctity of life, (6) the traditions of nursing, and (7) the fundamental goals of nursing. Each of these arguments is evaluated, and none are found to be convincing. This is crucial because the American Nurses Association’s official stance on nurse participation in assisted suicide can have significant consequences for the well-being of nurses who care for patients in jurisdictions in which assisted suicide is legally available. The American Nurses Association should therefore have a strong and convincing justification for opposing the practice, if it is to take such a position. That it fails to evince such a justification in its official statement on the matter places a burden on the American Nurses Association to more strongly justify its position, or else abandon its stance against nurse participation in assisted suicide. In September 2000, the self-styled “anthropological journalist” Patrick Tierney began to make public his work claiming that the Yanomamö people of South America had been actively—indeed brutally—harmed by the sociobiological anthropologist Napoleon Chagnon and the geneticist-physician James Neel. Following a florid summary of Tierney’s claims by the anthropologists Terence Turner and Leslie Sponsel, the American Anthropological Association (AAA) saw fit to take Tierney’s claims seriously by conducting a major investigation into the matter. This paper focuses on the AAA’s (...) problematic actions in this case but also provides previously unpublished information on Tierney’s falsehoods. The work presented is based on a year of research by a historian of medicine and science. The author intends the work to function as a cautionary tale to scholarly associations, which have the challenging duty of protecting scholarship and scholars from baseless and sensationalistic charges in the era of the Internet and twenty-four-hour news cycles. Members of the Ethics and Public Policy Committee of the International Society of Nurses in Genetics prepared this article to assist nurses in interpreting the American Nurses Association (2015) Code of Ethics for Nurses with Interpretive Statements (Code) within the context of genetics/genomics. The Code explicates the nursing profession’s norms and responsibilities in managing ethical issues. The nearly ubiquitous application of genetic/genomic technologies in healthcare poses unique ethical challenges for nursing. Therefore, authors conducted literature searches that drew from (...) various professional resources to elucidate implications of the code in genetic/genomic nursing practice, education, research, and public policy. We contend that the revised Code coupled with the application of genomic technologies to healthcare creates moral obligations for nurses to continually refresh their knowledge and capacities to translate genetic/genomic research into evidence-based practice, assure the ethical conduct of scientific inquiry, and continually develop or revise national/international guidelines that protect the rights of individuals and populations within the context of genetics/genomics. Thus, nurses have an ethical responsibility to remain knowledgeable about advances in genetics/genomics and incorporate emergent evidence into their work. (shrink)

We examine the role of the American Psychological Association (APA) in the weaponization of American psychology post-9/11. In 2004, psychologists’ involvement in the detention and interrogation of terrorist suspects generated controversy over psychological ethics in national security (PENS). Two signal events inflamed the controversy. The 2005 APA PENS Report legitimized clinical psychology consultation in support of military/intelligence operations with detained terrorist suspects. An independent review, the 2015 Hoffman Report, found APA collusion with the US Department of Defense (...) in producing the APA PENS Report and subsequent policies. Ongoing activities within APA to weaponize psychology sharpened the controversy. The authors—two psychologists and four former military/intelligence professionals—bring a military/intelligence operational perspective to detail two neglected areas of collateral damage. The first is the toll on psychology as a scientific enterprise. The second is covert influence on professional associations for incompatible security-sector objectives. We establish epistemic, historical, institutional, legal, and operational foundations for evaluation of these damages, as well as implications for APA and related professional associations in the ongoing Global War on Terror. An interview with the American Philosophical Association regarding my work as an academic.

At one time, the American Medical Association had a strong pro-life position regarding unborn human beings. Using an online AMA archives database, this research note contrasts early AMA pro-life commentary with its eventual pro-choice position. Strong pro-life advocacy in the mid-to-late 1800s, led by doctors such as Horatio Storer, gave way in the 1900s to a waning of pro-life zeal, and eventually developed into a pro-choice stance on abortion.

There are several key differences between the codes of ethics developed by the American Psychological Association and the Canadian Psychological Association. This paper tells the story behind the key differences between the U.S. and Canada codes. It starts with an introduction to the two countries and a brief history of what led up to the American Psychological Association’s (APA) decision to develop the world’s first ethics code for psychologists. This is followed by a description of (...) the development process used by APA, and the reasons why the Canadian Psychological Association (CPA) originally adopted the APA code but subsequently chose to develop its own “made-in-Canada” code of ethics. The key differences of the CPA code, the cultural, legal, and philosophical contexts that help explain the rationale for those differences, and why the differences have been maintained are discussed. In particular, attention is given to the CPA code’s strong focus on: (a) the concept of a contract with society; (b) aspiration vs. enforcement; (c) ethical reasoning and decision making; and (d) organizing standards around ethical principles. This article addresses the two main obstacles — ignorance and conflict — that block the pathway to ethically proper conduct, both generally in business and specifically in marketing. It begins with a brief examination of theories of the moral good which emphasizes the Greco-Roman humanistic tradition and the Judeo-Christian religious tradition. A professional code of ethics, such as the code of the American Marketing Association, is meaningful only if human beings are regarded as making moral judgments that, objectively (...) speaking, are morally wrong, that is only when the code is considered a set of moral absolutes.Following that, the question of ignorance is dealt with utilizing the American Marketing Association code of ethics. The specific items in that code are related to the three central principles of economic justice: equivalence, contributive justice, and distributive justice. In the second section, the question of conflict is encountered in the context of four other ethical principles — double effect, culpability, good end and bad means, self-determination — that are likely to be helpful in dealing with two cases that are especially instructive because they are limiting cases: the dilemma and the hard case.
